In Polk County District Court on September 20, 2023, with Judge James Marshall presiding, 193 cases were heard. Some cases were continued, dismissed or sent to superior court.   

 

The following persons were convicted of a crime:

Michael Joseph Barber was convicted of misdemeanor fleeing/eluding arrest. Barber was sentenced to 30 days in jail, suspended for 12 months of unsupervised probation and was fined $500 plus court costs.

 

Stacy Annette Bradley was convicted of driving without a license. Bradley was sentenced to 13 days in jail, with 13 days credit time served.

 

Elijah Quinn Burrell was convicted of driving without a license. Burrell was sentenced to one day in jail, with one day credit time served.

 

Baliya Cannady was convicted of possession of marijuana. Cannady was sentenced to one day in jail, with one day credit time served, must perform 24 hours of community service and pay court costs.

 

Steven Russell Clark was convicted of driving while impaired. Clark was sentenced to 30 days in jail, suspended for 12 months of unsupervised probation. Clark must also perform 24 hours of community service and was fined $100 plus court costs and community service fees.

 

Robert Frank Debiase was convicted of speeding. Debiase was fined $50 plus court costs.

 

Jose Garcia-Marquez was convicted of speeding. Garcia-Marquez was fined $50 plus court costs.

 

Russell Wade Gilbert was convicted of speeding. Gilbert was fined $25 plus court costs.

 

Tyler Mitchell Hill was convicted of simple possession of a Schedule VI controlled substance. Hill was fined $30 plus court costs.

 

Matthew William Holmes was convicted of driving without a license. Holmes was fined $50 plus court costs.

 

Brayan Isaac was convicted of driving with no operator’s license. Isaac was fined $50 plus court costs.

 

Deryan Alexander James was convicted of possession of a Schedule II controlled substance. James was sentenced to 8 to 19 months in jail, with two days credit time served, suspended for 24 months of supervised probation. 

 

Lovos Martinez was convicted of driving while impaired and carrying a concealed gun. Martinez was sentenced to 30 days in jail with one day credit time served, suspended for 12 months of unsupervised probation. Martinez must also complete a substance abuse assessment and 24 hours of community service, and was fined $100 plus court costs.

 

William Damon Pack was convicted of break and entering and possession of drug paraphernalia. Pack was sentenced to 120 days in jail, with 48 days credit time served, and must have no contact with the victim.

 

Frank Ross Payne was convicted of second-degree trespassing. Payne was fined court costs.

 

Lauren Victoria Shuler was convicted of driving while impaired. Shuler was sentenced to 30 days in jail, suspended for 12 months of unsupervised probation. Shuler must also complete a substance abuse assessment and 24 hours of community service and was fined $100 plus court costs.

 

Cody Drayton Sims was convicted of injury to personal property. Sims was fined $30 plus court costs.

 

Crystal Stewart was convicted of possession of drug paraphernalia. Stewart was sentenced to one day in jail, with one day credit time served.

 

Joshua Whittemore was convicted of possession of methamphetamine. Whittemore was sentenced to 5 to 15 months in jail, suspended for 24 months of supervised probation and must complete 24 hours of community service and a substance abuse assessment.
