Bond revoked in federal court Friday

TRYON—Former Tryon Commissioner Roy Miller recently violated his federal release by testing positive for cocaine.

Miller was in federal court in Asheville Friday, where details of his violation came out. Miller claimed that he thought the substance was Oxycodone, according to reports from court.

Miller was first arrested last April on charges of one count of conspiracy to commit federal program fraud, one count of federal program fraud, one count of extortion under color of official right and one count of witness tampering.

U.S Marshals arrested Miller on Monday for violating his pretrial release after he tested positive for cocaine. Miller has been in federal custody since Monday.

He appeared in court Friday morning before Judge Dennis Howell, where the details of the violation were unveiled and Miller’s bond was revoked, according to federal court documents.

Miller is now scheduled for a bond hearing on April 20.

Miller was arrested last April after it was discovered former Tryon Fire Chief Joey Davis used town credits cards to pay some of Miller’s personal bills.

Davis was also charged last year with one count of conspiracy to commit federal program fraud.

Davis was fired from the town last January. Miller resigned his town commissioner position on June 1, 2017.

The case of Miller and Davis is set for May 14.

Miller’s bond hearing is April 20 at 9 a.m. in Courtroom 2, located at 100 Otis St., Asheville. Judge Howell will preside over Miller’s bond hearing.
