Polk County Superior Court results for April 24

In Polk County Criminal Superior Court on Monday, April 24, 2017, with Judge Alan Z. Thornburg presiding, 11 trials and 48 cases were heard. Some cases were continued or dismissed.

The following persons were convicted of a crime:

Jason Michael Ahlert was convicted of attempted possession of a firearm by a felon. Ahlert was sentenced to 18 months probation and court costs.

Ervin Tony Bryant was convicted of three counts of attempted breaking and or entering. Bryant was sentenced to 227 days in jail with credit for time served and court costs.

Daniel Badger Franklin was convicted of possession of methamphetamine. Franklin was sentenced to 18 months supervised probation and court costs.

William Leland Henderson was convicted of four counts of breaking and or entering, larceny after break/enter, injury to real property and flee/elude arrest with motor vehicle. Henderson was sentenced to 120 days in jail with credit, 18 months supervised probation, $2,949 in restitution, 48 hours of community service and court costs.

James Patrick Miller was convicted of two counts of attempt to sell/deliver a schedule II controlled substance and two counts of maintain a vehicle/dwelling/place for a controlled substance. Miller was sentenced to 37 days in jail with credit, 18 months supervised probation and court costs.

Polk County District Court results

In Polk County District Court on Monday, April 24, 2017, with Judge T. Mack Brittain presiding, 179 cases were heard. Some cases were continued, dismissed or sent to superior court.

The following persons were convicted of a crime:

Crystal B. Ballenger was convicted of simple possession of schedule IV controlled substance. Ballenger was sentenced to five days in jail with credit.

Michael L. Foster was convicted of possession of drug paraphernalia and violation of court order. Foster was sentenced to four days in jail with credit for possession of drug paraphernalia and 15 days in jail for violation of court order.

Lona Lindsey Phelps was convicted of possession of drug paraphernalia and simple possession of schedule II controlled substance. Phelps was sentenced to 12 months unsupervised probation, a $50 fine and court costs.

In Polk County District Court on Wednesday, April 26, 2017, with Judge Emily Cowan presiding, 133 cases were heard. Some cases were continued, dismissed or sent to superior court.

The following persons were convicted of a crime:

Sally Diane Bell was convicted of simple assault. Bell was sentenced to 10 days in jail with credit for 10 days.

Christopher A. Boulton was convicted of operating a vehicle with improper equipment. Boulton was fined $40 and court costs.

Shay Brianne Carlson was convicted of level five driving while impaired. Carlson was sentenced to 12 months unsupervised probation, one day in jail, a $100 fine and court costs.

Taylor Christie Carter was convicted of speeding 74 mph in a 65 mph zone. Carter was fined $50.

Erick Lawrence Chapman was convicted of speeding 74 mph in a 65 mph zone. Chapman was fined $50 and court costs.

Devin Mitchel Dalton was convicted of contributing to the delinquency of a juvenile. Dalton was sentenced to 12 months supervised probation and court costs.

Sarah Susan Fink was convicted of possession of marijuana up to ½ ounce. Fink was fined $50.

Charles D. Grimley was convicted of operating a vehicle with improper equipment. Grimley was fined $40.

Andrew Benjamin Hamilton was convicted of first-degree trespassing. Hamilton was sentenced to 12 months unsupervised probation and court costs.

Steven Paul Hobbs was convicted of speeding 34 mph in a 25 mph zone. Hobbs was fined $50.

Gabriel M. Seppala was convicted of simple possession of a schedule IV controlled substance. Seppala was sentenced to eight days in jail with credit for time served.

Jacosa Lynn Tefft was convicted of failure to appear. Tefft was sentenced to 12 months unsupervised probation, a $50 fine and court costs.

Devan Toney was convicted of first-degree trespass. Toney was sentenced to one year unsupervised probation and court costs.

Josie Coleen Yates was convicted of level five driving while impaired. Yates was sentenced to 12 months unsupervised probation, one day in jail, a $100 fine and court costs.

Columbus Police Department

During the month of March 2017, the Columbus Police Department answered 595 calls for service.

There were 11 arrests, including three felony arrests, eight misdemeanor arrests and one driving while impaired. There were 127 charges, including 62 speeding citations, seven no operator’s license, two driving while license revoked, five drug charges, three uninsured motorists, nine careless & reckless driving, seven registration violations and four open container.

Officers completed 114 residence checks, 8,233 business checks and 213 church checks.

The Columbus Police Department was requested to assist other agencies 24 times for a total of 15.67 hours, completed 286 community patrols and received 216 hours in training.

During the month of March 2017, the Columbus Fire Department answered 87 calls for service.

Calls included one mobile property (vehicle) fire, one forest, woods or wildland fire, 15 medical assist, assist EMS crew, five EMS calls, excluding vehicle accident with injury, one motor vehicle accident with no injuries, one power line down, one aircraft standby, one public service assistance, two assist police or other governmental agency, one good intent call, two dispatched and cancelled en route, one no incident found on arrival, two smoke scare, odor of smoke, one false alarm or false call, one passenger vehicle fire in Columbus Township, one off-road vehicle or heavy equipment fire in Columbus Township, one grass fire in Columbus Township, 19 medical assist, assist EMS crew in Columbus Township, two emergency medical service in Columbus Township, two EMS call, excluding vehicle accident with injury in Columbus Township, two motor vehicle accident with injuries in Columbus Township, two search for person on land in Columbus Township, two hazardous condition in Columbus Township, one gasoline or other flammable liquid spill in Columbus Township, one public service assistance in Columbus Township, one public service in Columbus Township, one dispatched and cancelled in Columbus Township, one no incident found in Columbus Township, two false alarms in Columbus Township, one forest, woods or wildland fire in Green Creek, one brush or brush and grass mixture fire in Green Creek, one dispatched and cancelled in Green Creek, one public service assistance in Green Creek, two building fires in Mill Spring, one dispatched and cancelled in Mill Spring, one authorized control burn in Mill Spring, one false alarm in Saluda, one dispatched and cancelled in Sunny View, one forest, woods or wildland fire in Tryon, one dispatched and cancelled in Tryon and one smoke scare, odor of smoke in Tryon.
