Residence to be vacated after 60 days

 

GREEN CREEK – On Wednesday May 18, Superior Court Judge William H. Coward signed a consent judgment for a Chapter 19 nuisance abatement action against the property owner of 301 Claude Gilbert Rd in the Melvin Hill area of Green Creek. 

 

This action was the final step in a civil nuisance abatement brought together by the Polk County Sheriff’s Office and NC Alcohol Law Enforcement (ALE). The terms of the consent judgment calls for the property to be sold, as well as a written agreement stating that the future use of the property would not include nuisance related activities. The judgment also ordered the property to be vacated after 60 days. 

 

According to Scottie Shoaf, the assistant special agent in charge of the nuisance abatement team, the nuisance abatement law provides a solution to problem locations that strain law enforcement resources and reduce the quality of life for others. 

 

With many calls of service, drug violations and other disturbances at the Green Creek property coming to an end, Polk County Sheriff Tim Wright praised the NC ALE and the surrounding citizens, saying “I commend the citizens and the NC ALE for partnering with us to ensure this community returns to a peaceful life. This address has been a problem for years, causing the community to live in fear and constantly draining emergency services and law enforcement resources.”
