Editor’s note: Mary Prioleau said she felt like she was in the middle of a bad April Fool’s joke last week. She was incorrectly listed as owing taxes that she paid in an ad taken out by the Town of Tryon in the Bulletin’s Monday, April 1 issue. Then in the Bulletin’s Friday, April 5 issue she was listed as having been convicted of simple assault in superior court, when there was actually no judgement made. The case was remanded back to district court, where there was a “prayer for judgement continued.” According to N.C. General Statute 151A-101, a prayer for judgement continued means that upon payment of court costs, which Prioleau was not ordered to pay, it does not constitute the entry of a judgement. The Bulletin apologizes to Prioleau for its misinterpretation of the superior court results.

 

In Polk County Superior Court Administrative Session held March 27, 2013 with Judge Mark E. Powell presiding, 111 cases were heard. Some cases were continued or dismissed.

The following persons were convicted of a crime:

Gregory Stephen Garner was convicted of felony probation violation out of county. Garner’s probation was revoked.

Zachery David Hodges was convicted of robbery with a dangerous weapon. Hodges was sentenced to 61-83 months at the N.C. Department of Corrections.

Ashley Lynne Leija was convicted of felony probation violation out of county. Leija’s probation was terminated.

William Damon Pack was convicted of four counts of misdemeanor child abuse, manufacturing methamphetamine, possession/distribute meth precursor and maintaining a vehicle/place/dwelling for a controlled substance. Pack was sentenced to 150 days at the N.C. Department of Corrections for misdemeanor child abuse and 67-93 months at the N.C. Department of Corrections for manufacturing methamphetamine, possession/distribute meth precursor and maintaining a vehicle/dwelling/place for a controlled substance.

Hollys Lavon Williams was convicted of felony probation violation. Williams’ probation was revoked.
