Abril DWI case delayed

Driving while impaired (DWI) and larceny charges are still pending against former Polk County Sheriff Chris Abril as the case was continued during Wednesdays district court session.
Prosecutors were ready to move forward this week, but the case was continued until March 3 at the request of Abrils attorney.
Abril was charged after being stopped last October on U.S. 176 in Tryon after leaving Elmos Pub and Grill. Abril refused a breathalizer. He was charged with driving while impaired, open container, driving left of center and later misdemeanor larceny charges for allegedly stealing a drink at Elmos. The passenger with Abril, Jose Jamie Rosales Zavala, 24, was also charged with misdemeanor larceny.
