Under the agreement Tryon and CAFA (Citizens Against Forced Annexation) are currently considering, Tryon would agree not to annex the property until 2013 if CAFA would agree to drop the current lawsuit and not sue again in 2013.

Both parties would have to agree to the settlement, including a majority on both sides.

CAFA sued Tryon about a year ago after the town involuntarily annexed about 406 residents in the Gillette Woods, Country Club Road, Harmon Field Road and Hwy. 108 areas of Tryon township last April. That annexation followed a previous involuntary annexation that encompassed much of Lynn. The town rescinded&bsp; that annexation after being sued by CAFA the previous year.

The current CAFA lawsuit included about 172 petitioners who agreed to sue the town.

A hearing on the lawsuit was held on July 13 in Polk County Civil Superior Court. Judge Richard Doughton met with attorneys and the settlement was proposed.

The town and CAFA were given until the end of July to make a decision on whether to settle the lawsuit. If both sides agree to the settlement, Judge Doughton will write an order for the annexation not to take effect until Jan.1, 2013.

If one or both sides don&squo;t agree to the settlement, hearings in the lawsuit will proceed, possibly as early as mid-August.
