It is unclear what other matters the state was referring to, but they could include an investigation earlier this year that was turned over to the district attorney&squo;s office by Polk County Manager Ryan Whitson involving checks in a special jail fund within the sheriff&squo;s office and an audit of that fund. Whitson a few months ago turned over checks to the DA&squo;s office and said yesterday that he did not know what was occurring in that case.

Coman asked Judge Zorro Guice Jr. on Monday during superior court to put forth the strongest penalties by law for Abril. Abril pleaded guilty to two counts of solicitation to take indecent liberties with a minor for incidents occurring 20 years ago with girls ages 10 and 11 at the time. As requested by Coman, Judge Guice included alcohol and drug clauses attached to Abril&squo;s supervised probation.

Abril&squo;s attorney, Stephen Lindsay, said Abril has already suffered in the matter, especially financially by resigning as sheriff, a position that paid more than $50,000 per year with benefits for his family, Lindsay said.

Lindsay also argued that the state brought forth no evidence Monday that alcohol or drugs were a factor in the case and therefore Abril should not be subject to those probation clauses.
